Alan J. Arville is a Member of Epstein Becker Green firm in the Health Care and Life Sciences practice, in the Washington, DC, office.
Mr. Arville provides strategic, transactional, and regulatory guidance to the health care industry. Mr. Arville’s legal practice primarily focuses on matters relating to the distribution, dispensing, and reimbursement of pharmaceuticals, including the Medicare Part D program, the Medicare Advantage program, the 340B Drug Discount Program, federal anti-kickback and anti-inducement laws, HIPAA privacy and security, health care licensing, drug purchase agreements, payor contracting, and affiliations and other collaborative arrangements. His clients include regional and national pharmacy chains; specialty pharmacies; health care systems; disproportionate share hospitals, federal grantees, and other 340B covered entities; drug manufacturers and distributors; group purchasing organizations; and pharmacy services administrative organizations. In addition, a substantial portion of Mr. Arville's practice involves representing private equity firms in the evaluation, due diligence, and acquisition of health care companies.
Mr. Arville regularly advises pharmacies (chain and independent pharmacies, retailers with pharmacy operations, and specialty pharmacies) on a diverse array of transactions and compliance issues, including patient reward and drug discount programs, manufacturer and third-party payor relations, Medicare Part D compliance, medication therapy management services, health and wellness programs, data sharing arrangements, 340B contract pharmacy arrangements, and limited distribution network and other specialty pharmacy models.
Mr. Arville also has extensive experience working with disproportionate share hospitals, federal grantees, and other 340B covered entities, contract pharmacies, and 340B management service providers on 340B compliance, outlook, and strategy. To this end, Mr. Arville regularly represents covered entities in connection with the implementation of 340B compliance policies and procedures, contract pharmacy arrangements, self-assessments, and independent audits. He also assists covered entities with HRSA audits, manufacturer audits, and self-disclosures.
Prior to joining Epstein Becker Green, Mr. Arville was a Principal in the Health Law Group of a national law firm.
Mr. Arville was named to the Washington DC Rising Stars list (2013) in the area of Health Care and ranked as one of the "Outstanding Young Healthcare Lawyers for 2008" by Nightingale's Healthcare News. A contributor to the Health Law Advisor blog, he is the author of numerous articles and a frequent speaker on health care topics
